Terms of Service

These Terms of Service ("Terms") govern your use of the Aro Cut website (arocut.com) and the Aro Cut iOS application ("Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
These terms are a working draft and have not yet been reviewed by legal counsel. They will be finalized before launch.
1. Service Description
Aro Cut is a native iOS application for professional 360 photo booth operators. The Service includes on-device video capture and processing, local and server-side sharing, guest content delivery, and event management tools.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use the Service. By subscribing, you represent that you have the legal authority to enter into these Terms.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@arocut.com if you suspect unauthorized access.
4. Subscriptions and Billing
Aro Cut is offered as a paid subscription service with multiple tiers (Starter, Pro, Enterprise). Starter and Pro are priced per booth. Enterprise pricing is custom and may vary based on booth count, retention requirements, support scope, and organizational controls.
Billing Path
Starter and Pro are intended for self-serve billing through the App Store. Enterprise is handled through direct sales for customers who need procurement review, custom contracts, or negotiated usage terms. Check the pricing page for the latest public offer.
Quota and Overages
Each plan includes monthly quotas for SMS messages, emails, and active cloud storage. When an SMS quota cap is reached, SMS delivery pauses until the next billing cycle, an eligible paid add-on is purchased, or the plan changes. When an email quota cap is reached, email delivery pauses until the next billing cycle or the plan changes. Quotas do not roll over between billing cycles. Storage retention follows the plan-specific retention window then in effect.
Cancellation
You may cancel your subscription at any time, subject to the billing path in effect when you purchase. Starter and Pro cancellations and refunds are governed by the App Store policies applicable to your purchase. Enterprise agreements follow the terms in your contract.
Price Changes
We may adjust pricing with reasonable advance notice. Self-serve App Store subscriptions will follow Apple's price-change rules, while Enterprise pricing changes will be handled through direct customer notice or contract renewal.
5. Acceptable Use
You agree not to use the Service to:
- Send unsolicited messages (spam) to guests or any third party
- Collect or transmit personal data without required consent from data subjects
- Distribute content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
- Interfere with the operation of the Service or its infrastructure
- Attempt to reverse-engineer, decompile, or extract source code from the application
- Use the Service for any purpose that violates applicable law
6. Operator Responsibilities
As a booth operator, you are responsible for:
- Guest consent: Obtaining any consent required by applicable law before entering guest phone numbers or email addresses into the app for content delivery
- Content legality: Ensuring that all branding, overlays, and content distributed through the Service complies with applicable law and does not infringe third-party rights
- Event compliance: Complying with venue rules and local regulations regarding photography, data collection, and electronic communications at your events
We act as a service provider processing guest data on your behalf. You remain the party responsible for the lawfulness of that data collection.
7. Suspension and Termination
We may suspend or terminate your access to the Service if:
- You violate these Terms or the Acceptable Use policy
- Your use generates spam complaints, delivery failures, or abuse reports that exceed reasonable thresholds
- Your account is used for unlawful activity
- You fail to pay subscription fees when due
Where possible, we will provide notice before suspension and an opportunity to resolve the issue. In cases of severe or ongoing abuse, we may act immediately.
8. Intellectual Property
The Aro Cut application, website, documentation, and brand assets are owned by Aro Cut and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.
You retain ownership of all content you create, upload, or distribute through the Service (branding assets, captured media, overlays).
9. Service Availability
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. Core capture and local sharing features operate on-device and do not depend on our servers.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will meet all your requirements, operate without interruption, or be free of errors. On-device performance depends on your hardware, environmental conditions (temperature, connectivity), and usage patterns.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Aro Cut shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
Our total liability for any claim related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold Aro Cut harmless from claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights — including claims arising from guest data you collected or content you distributed through the Service.
13. Governing Law
These Terms are governed by [jurisdiction to be confirmed before launch]. Any disputes will be resolved in the courts of that jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use of the Service after changes constitutes acceptance.
